滥用知识产权限制竞争的反垄断规制

为了取得有利的竞争地位，知识产权的持有者往往利用知识产权的专有特性，不正当地行使知识产权，超越法律所赋予的合法垄断的界限，限制公平自由竞争。我国《反垄断法》第55条对滥用知识产权的行为进行了原则性的规定，但因其过于抽象而不具有操作性。因此，有必要在借鉴他国成熟经验的基础上，逐步完善我国对滥用知识产权限制竞争行为的反垄断规制。

Antimonopoly Regulations to Limit Competition with Ill-used Intellectual Property Right

For an advantageous status,the holders usually take advantage of the unique features of intellectual property right,illegally enforce the rights and surpass the boundary of legal monopoly so that the fair and free competition has been limited.Provision 55 in Antimonopoly Law of China principally defines the ill-used intellectual property right,but it is hard to operate because of its over Abstraction.So it is necessary to perfect it according to the experience from other countries.
