| 摘 要： | 对国家法及民间法在解决纠纷中各自的作用进行了具体分析。指出现代化进程中的乡土社会既有着乡土本色的底蕴,又有着法制化的内涵。在其纠纷的解决中虽然民间法的作用仍然功不可没,但是国家法日益发挥着主导性的作用。国家法强调人们和平共存、相安无事,民间法则要求人们友好相处、互相帮助,国家法可以通过民间法更好地发挥作用。
