环境侵权的特征分析

环境侵权越来越成为我国的一大社会问题。环境侵权的特征乃是环境侵权迥异于传统侵权行为的内在根基。环境侵权的特征,只能是从总体上而言,其相对于现实生活中各种具体的环境侵权形态尚有一定的伸缩性与相对性。其特征主要有:1、主体:不平等性、不可互换性与不特定性;2、对象的广泛性与客体的多样性;3、原因行为:价值双重对立性;4、侵害过程:间接性、持续性与复合性;5、损害结果:潜伏性、滞后性与放大性。

Environmental torts are increasing becoming a social problem in our country.The characteristics of environmental torts are the internal basis on which environmental torts are different from the traditional torts.The characteristics of environmental torts can only be defined in terms of generality.There can be some elasticity and relativity when compared with the particular forms of environmental torts in real life.The characteristics of environmental torts are as Follows:First,the inequulity,noncommutability and uncertainty of the subject; Second,the largeness of the target and the variety of the object; Thirt, dual antithesis in value of the cause action; Fourth,the complexity, indirectness and continuity of the damage process;Fifth,the latency,hysteresis and amplification of the harmful consequences.
