| 摘 要： | 目前,学界对法律逻辑的学科性质众说纷纭,莫衷一是。归纳起来,主要有形式逻辑分支论、应用逻辑分支论和理论法学分支论3种。在我国,虽然理论法学分支论最近才有个别学者以模糊的语气谈及,并且一经提出便遭到许多学者的质疑,但经过分析,就会发现,理论法学分支应该是法律逻辑的最佳归宿。

| Abstract: | At present, scholars have different views as to the nature of legal logic, and it is difficult to tell who is right. Their opinions concern formal logic theory, applied logic theory and jurisprudential theory. Though, only a few of scholars talk about jurisprudential theory in obscure language and fail to expand it at length, we think the third one is the best by appraisal. |
