试论中国区际仲裁裁决司法协助制度中的几个问题

中国内地与港、澳、台之间相互承认与执行仲裁裁决的区际司法协助问题历来是两岸四地研究区际法律冲突、区际司法协助的学者们关注讨论的问题。尤其是为解决中国目前两岸四地的区际仲裁裁决司法协助,内地和港澳地区签订了《关于内地与香港特别行政区相互执行仲裁裁决的安排》、《关于内地与澳门特别行政区相互认可和执行仲裁裁决的安排》两个"安排"之后,安排中存在的问题及其差异更是引发学者们讨论的兴趣。安排中各地区对管辖法院、区际裁决的认定、公共秩序的适用等问题尚存差异,从两岸四地相互认可和执行仲裁裁决的实践看,其问题逐渐显露。这些问题在实现统一区际司法协助立法中值得思考和探讨。

Several Problems on China Interregional Arbitration System of Judicial Assistance

The inter-regional mutual recognition and enforcementof arbitral awards under "one country two systems four law territories" is an important thesis for scholors of China Mainland and HongKong,Macao,Taiwan.In order to solve these problemes,the Mainland signed Agreement between China Mainland and HongKong SAR on Mutual Enforcement of Arbitral Awards and Agreement between Mainland China and Macao SAR on Mutual recognition and lEnforcement of Arbitral Awards with HongKong and Macao.The scholors take more interests in these agreements after they come into force.Jurisdiction,recognition and enforcemen of inter-regional arbitral award,the public order are different in different regions,in the practice of the inter-regional mutual recognition and enforcementof,the problems are prominent,they all need thinking and discussion.
