| 摘 要： | 在体育竞赛中,运动员付出了艰辛的努力,其表演权应当受到法律的保护.尽管国际公约和大多数国家的著作权法及实施条例没有把体育竞赛表演纳入到表演法律保护中,但体育竞赛在本质上与演员的表演没有本质区别,应当受著作权法、人格法、国际人权公约和宪法、合同法、反不正当竞争法等的保护.

| Abstract: | In sports matches athletes paid hard work, performers＇ fights should be protected by law. Al- though the international conventions and copyright laws in most countries and the implementing regulations did not include the legal protection of sports matches performers＇ right, there is no essential difference between sports performance and the actors＇performance. It is also protected by copyright law, personality law, international human fights conventions and the Constitution, contract law, law against unfair competition. |
