| 摘 要： | 目前WTO框架下规范出口限制措施的规则较少,GATT第11条第1款是其中的主要条款。此外,不少新加入成员在WTO规则之外对出口税也作了约束承诺,这些规则和承诺已经不能适应现实需要,亟需对其进行细化并使其对出口税的约束成为所有成员的普遍纪律。

| Abstract: | At present, there are only a few rules regulating the use of export restriction measures under the GATI？/WTO rule system, and article XI： 1 of GAIT is the main regulating rule among them. Besides, many new members made commitment in the area of export duties outside of WTO rules. These rules and commitment are not adequate to deal with export restrictions, therefore it is vital to improve the rules concerning the export restriction and make the export duty a general commitment to most members. |
