也论民事执行权的性质及其配置

通过对民事执行权性质的剖析,认为民事执行权当属兼有司法权和行政权特征之独立的国家公权力;进而基于国情认为我国应采用“独立核心一元制”的执行机构模式,即将民事执行机关设置在检察院系统,设置相对独立的民事执行科,而在法院系统保留执行法官,并以民事执行科为核心组织多种国家力量完成执行程序。

Characteristic Division and Disposition of Civil Enforcement Power

By profoundly analyzing the character of civil enforcement power,the author considers that the civil enforcement power should be an independent state power combining characters of judicial power and administrative power.Furthermore,in regard to the present condition of our country,we should adopt a pattern of "independent core system" of enforcement organ,namely,to establish a civil enforcement organ in the procuratorate unite and reserve the relatively independent civil executing section in court.Meanwhile,enforcement judges in court should be retained and the civil enforcement section should function as a leading body to organize various state power to accomplish the procedures of enforcement.
