社会纠纷解决中的法制建设问题

我国现阶段法制建设的客观环境和社会纠纷的特殊性及其特点决定了法制建设在纠纷解决中具有重要作用。但法制建设在立法方面仍然存在体系不完善，科学性、民主性和创新精神均需要加强的问题，尤其是综合治理法、突发事件应急法等亟须制定；在执法和司法方面，存在行政执法不严、司法权威需要树立、司法效率需要加强的问题；在守法主体方面，存在法律意识培养不到住的问题。这些都需要给予重视并加以解决。

The Function of Law in the Resolution of Disputes

The law plays important role in the resolution of disputes because the rule by law and the characteristics of disputes in China now. But there is still deficiency in the legislation, such as incomplete systems, absence of the democracy, scientificnature and innovation, especially the lack of the law about comprehensive treatment, the procedures on crisis. Added to these, there are also slack law enforcement, injustices in administrative justice, the shortage of authority and efficiency in judicatory. At last, we found the legal consciousness of citizens, government and enterprises is not well. In a word, all this are important, we must resolve them.
