| 摘 要： | 全球人是世界经济发展的必然产物,经济的全球化,亦渗透在法律方面,文中对《合同法》与《联合国国际货物销合同公约》和《国际商事合同通则》的比较,阐明《合同法》一方面借鉴、吸收、移植了后两者的成果,反映了全球化过程中的立法趋同化潮流的影响,另一方面,它又根据我国的实际情况和国际经济贸易发展的需要,保持了自己的本土化性格。

| Abstract: | This paper deals with the Contract Law from a view of globalization.By comparing the Contract Law with both the UN Convention on Contracts for the International Sale of Goods and the Principles of International Commercial Contracts,this paper reveals that,on the one band the Contract Law reflects the need of international integration of legislation,and at the same it has absorbed and transplanted their essence.On the other hand,the Contract Law retains the Chinese characteristics on the basis of China's practical situation. |
