| 摘 要： | 我国立法没有用专门条文集中规定继承制度的基本原则,因此学者对继承法的基本原则有很大的认识分歧。本文从民法基本原则的理性分析入手,紧扣继承法与民法的关系和继承法的立法精神,对继承法诸原则一一检讨,得出我国继承法应确立"三原则"体系的结论。

| Abstract: | In Chinese legislation, there're no conerete articles to regulate intensively the basic principles of the Inheritance Law. Thereby, the scholars have divergent views on them. From the basic principles of the Civil Law, this paper focuses on the relations between the Inheritance Law and the Civil Law and the legislation spirit, theoretically discussing the principles of the Inheritance Law. Then it comes to the conclusion that Inheritance Law should stipulate the following three principles. |
