| 摘 要： | 高校作为一种特殊的社会组织，既具有行政法律关系主体资格，又具有民事法律关系主体资格。高校是典型的授权组织，其行政法律关系主体资格，可以从行政法理、法律法规授权、司法救济、高校与教师学生的关系等方面来分析确定。

| Abstract: | As a kind of special social organizations, higher schools are qualified not only as subjects with administrative legal relations, but also as subjects with civil legal relations. Higher schools are typical authorizing organizations, which confirmed by administrative law, qualification as administrative legal relations subjects can be analyzed and law and regulations authorization, justice redress and the relations between higher schools and teachers and students. |
