浅析庞德的利益论与社会控制论

罗斯科.庞德是20世纪英美法系最为著名的社会学法学家。利益理论和社会控制论是其社会学法学思想中两大核心内容。庞德认为,人的本性贪婪,而社会资源有限,人们的权利主张和利益需求必然会彼此重叠和相互冲突。为了减少或者避免这种摩擦,社会需要一种有效的手段来确立一种文明的秩序。法律就是这种有效的社会控制手段。法律的目的就是确立、承认、协调和保障各种利益,控制人的本性,以最低限度的阻碍和浪费来满足各种利益需求,从而实现最大可能的正义。

Analysis of Pound's Interest Theory and Social Control Theory

Roscoe Pound was the most famous jurist of society in the 20th century Anglo-American legal systems,and his sociological legal thinking has always been of concern to scholars.Interest theory and social control theory,the two core ideas,are the sociological jurisprudence thought.Pound thought that the greed is human nature,and social resources are limited,so people＇s claims and interests of the demand will inevitably overlap and conflict.In order to reduce or avoid such friction,the community needs an effective means to establish a civilized order.The law is such an effective means of social control.The purpose of the law or authority is designed to establish the recognition,coordination and protection of various interests to control human nature,with a minimum of obstruction and waste maximally meeting the needs of various interests in order to achieve the greatest possible justice.
