On the Choice of the Value Position of Penalty in the Risk Society

The risk society is the result of rapid technological development. To make the appropriate distribution of benefits, it is our focus, how criminal law and penalty find a balance point between the damages of risks and interests. Even if we have the emphasis on the doctrine of severe punishment, we cannot remove the inner fears to risk and the facts on human nature denied by instrumental rationality. In fact, the non-balance between non-aggravated penalty and increasing risk reflects yet the most deeply equilibrium.
