涉外知识产权侵权保护的思考

知识产权跨国交流在当下日趋重要，我国知识产权国际交流过程中因缺乏相关的规定而问题百出。我国《中华人民共和国涉民事关系法律适用法》（以下简称《法律适用法》）的制定，填补了我国知识产权法律适用立法的空白。然其仅以3条之规定对知识产权的法律适用及保护做了笼统的概括。本文将从涉外知识产权法律适用争论入手，通过对我国《法律适用法》关于知识产权侵权保护规定的条文进行分析，进而提出相关立法建议。

Some Reflections on Infringement of Foreign Intellectual Property Protection

The transnational exchange of intellectual property rights is increasingly important in the moment. While there are many problems due to lack of provisions related to the protection in China. People＆#39;s Republic of China Act on the application of law （hereinafter referred to as applicable law） developed to fill the gaps in the intellectual property legislation on law application in China. However , it is a generalization of intellectual property rights and protection with only 3 provisions of applicable laws. This article started from the law applicable to foreign-related intellectual property rights controversy. It analyzed the provisions of infringement of intellectual property rights protection and put forward relevant legislative proposals.
