论自由裁量权的合理性控制

自由裁量权在行政领域的作用有如双刃剑,既能推进行政机关积极行政,提高行政效能;同时也存在被滥用的可能性。传统行政法治所提出的合法性控制越来越软弱无力,运用合理性原则对行政自由裁量权进行控制日显重要。针对自由裁量权合理性控制中所存在的一系列问题,要重构行政合理性原则与自由裁量权两者之间的协调关系,一方面充分发挥自由裁量权的作用,另一方面要对其进行有效的监控,以期达到授权与控权的平衡。唯有如此,才能最终实现行政法治。

On the Rational Control of Discretionary Power

The role of discretionary power in the administrative areas is like a double-edged sword.On one hand,it can give full play to administrative agencies and improve the administrative efficiency.On the other hand,it may be abusively used.The legal control of the traditional administrative law is becoming weaker and weaker,so how to reasonably use discretionary power is increasingly important.The paper points out a series of problems and tries to reconstruct a coordination relationship between the rational administrative principle and the discretionary power.
