网络著作权侵权行为的认定研究

网络作品一般既符合传统作品的构成要件,又符合法律关于网络作品的特别规定,包括上网作品和网上作品。网络著作权侵权行为认定时依然要适用行为的违法性、损害事实、因果关系和主观过错这四个最基本的构成要件。网上著作权侵权主要有将网上作品下载并发表到传统媒体上、将传统作品上传到网上、链接、浏览以及网页抄袭等几种形式。

On Determination of Infringement of Online Copyright

Generally speaking online works (including both the works that are to be put online or those created online) satisfy the necessary components for traditional works and the special legal requirements for online works. In determining the infringement of online copyright, the four fundamental components for traditional works shall also be considered, that is illegitimacy of the acts concerned, fact of damage, cause and effect, and subjective faults. The infringement of online copyright mainly includes downloading online works to publish on traditional media, uploading the traditional works online, linking, surfing and copying online works.
