英汉法律词语空缺与译者的主体性

法律术语翻译历来是法律翻译的重点和难点之一。受不同国家、地区语言和法律文化影响,不同法律体系都有其独有的术语系统。不同法律体系之间术语的不对应,导致了法律词语空缺现象,构成了法律术语翻译的最大障碍,并在翻译实践中产生了很多问题。要解决这些问题,需要译者在翻译实践中站在决策者的高度,发挥其主体性和创造性。这同时也对译者自身素养提出了较高要求。

Lack of Equivalent English-Chinese LegalWords and Subjectivity of Translators

The translation of legal terms has always been the emphasis and one of the difficulties in legal translation.Influenced by the languages and legal cultures of different nations and districts,different legal systems have their special systems of terminology.And the terminological incongruency between different legal systems causes the lack of equivalent legal words,which becomes one of the biggest obstacles and causes a lot of problems in legal terminology translation.To solve these problems,translators are supposed to work as decision makers and bring their subjectivity and creativity into full play in the translation practice.Meanwhile,the high quality of translators is also required.
