| 摘 要： | 海峡两岸实现＂大三通＂后,客观上要求实现判决自由流动,因此两岸有必要建立一个有利于判决承认与执行的新机制。本文分析了海峡两岸民商事判决的相互承认与执行的现状及存在的问题,认为理想的模式是在＂一国两制＂基础上通过平等协商达成民商事判决的相互承认与执行的司法协助协议。
