英国安全生产行政许可制度初探

从职业安全健康立法、机构和安全生产行政许可的范围、法律依据、实施主体等方面研究了英国的职业安全监管体系和安全生产行政许可制度;总结提出英国设立安全生产行政许可的四大基本原则,即高风险许可原则、企业主体责任原则、目标设定型原则和监管有效性原则。从许可的种类、范围、法律依据和实施主体四个方面,进行了中英安全生产行政许可比较,分析了异同之处。认为应学习借鉴英国的先进经验和做法,不断完善我国安全生产监管监察体制和安全生产行政许可制度。

Research on OSH Permission Regimes in Britain

It researched the British occupational safety and health （OSH）supervision system and permission regimes, including 0SH legislation, organization and safety permission scope, the legal basis and implementing subject. Sums up and put forward four basic principles of Britain safety permission, as high - risk permission principle, enterprise＇s main responsibility principle, set goals principle and effective supervision principle. From the kinds, scope, legal basis and implementing subject of permis- sion, it compared and analyzed safety permission between Britain and China. It puts forward that we should learn from Britainfi ad- vanced experience and practice, and constantly improve 0SH supervision system and administrative permission regimes in China.
