| Abstract: | If we want to have a correct idea of the legislation spirit of the goodwill obtainment system of stolen goods stipulated by Property Law and the relative laws as well as judicial explanation and solve the intercrossing and conflicting problem of the goodwill obtainment system of Property Law and recovery of stolen goods in the criminal law, we must consult the foreign goodwill obtainment system of stolen goods and the relative cases and generalizes the legislation practice and the basic views on whether the stolen goods of criminal law is suitable for the goodwill obtainment system. |
