| 摘 要： | 现行刑法确立了＂罪刑法定＂的基本原则,贯彻实施罪刑法定原则不仅仅是一个立法技术问题,而且是一次深刻的刑法观念大变革,是刑法价值观念的重塑过程。笔者先阐述罪刑法定原则的思想渊源及其基本内涵,接着分析了其在我国的实践缺陷,最后提出了完善该原则的几点建议。

| Abstract: | The cement penal code establishes the basic principle ＂conviction and penalty according to law＂.The implementation of the principle is not only a technical problem,but also a profound revolution of the concept of the criminal law,which is the process of remodeling criminal law values.The paper first elaborates the principle of legality and its ideological sources of the basic content,followed by an analysis of its deficiencies in our practice.Several suggestions are also put forward to improve the principle. |
