| 摘 要： | 合同格式条款是体现单方意志性的定型化契约条款,它与传统契约自由原则相违背,所以有人质疑它存在的合理性,但在现实生活中格式条款却有强大的生命力。从"存在的就有一定的合理性"的哲言出发,可以揭示出格式条款存在的合理价值。
