论知识产权范围的重新界定

随着现代科技的发展和发展中国家自身利益保护意识的增强,传统知识和生物多样化资源越来越强烈地要求得到知识产权的保护,而现有知识产权范围中的有关权利无法概括保护传统知识和生物多样化,因此知识产权的范围必须予以重新界定。这是保护广大发展中国家利益的需要,也是传统知识和生物多样化对现代知识产权性质和特征的突破所要求的。

Intellectual Property Right should be redefined to cover.The necessity of Intellectual Property Right Redefinition is resulted from the need of protection of the developing countries,the breakthrough of traditional knowledge and diversified biological beings from IPR;and finally,the failure of the present intellectual property right to cover traditional knowledge or the biological diversity.
