论“其他财产”抵押权的物上追及力与对抗第三人的例外

我国对于动产抵押采取登记对抗主义的方法,动产抵押权自抵押合同生效时设立。根据《物权法》第一百八十第一款条第(七)项,"法律、行政法规未禁止抵押的其他财产"属于可抵押财产之范围,具体应包括其他动产、部分限制流通物以及某些财产性权利等。就此类财产的抵押是否应当登记,登记的效力如何以及抵押权对抗第三人的范围的程度,现行法律并没有明文规定。因此,从立法者本意的角度出发进行具体情况具体分析,努力澄清该模糊之处,对于动产抵押登记制度的理论研究和司法实践都甚有裨益。

On the Force of Recourse and the Exception Against Third Party in Other Property Mortgage

Our country adopts the legislative pattern of register resisting doctrine for chattel mortgage.The right to chattel mortgage shall be established since the mortgage contract comes into effect.According to Law No.7 Section 180 of China＇s Property,other properties which the laws and administrative regulations do not prohibit mortgaging belongs to the range of chattel mortgage,specific including other movables,part of limited circulation and some property rights,etc.The law does not stipulate whether it should be registered,how the effectiveness of its registration, and how to divide the scope of against third party.Studying the legislators＇ real intentions by concrete analyses to specific condition,the author makes an effort to clarify the ambiguities,hoping it＇ s beneficial for the theoretical research and the judicial practice of chattel mortgage registration system.
