| 摘 要： | 党的十八大报告指出要不断完善科技创新激励机制。科技创新活动具有很强的正外部性，其对国家经济和社会的发展有极大的推动作用。为了激励科技创新正外部性，必须在借鉴国外经验的基础上，坚持适当性、比例性、创新性及法定性原则，健全科技创新正外部性激励的税收法律制度、财政法律制度、政府采购法律制度、金融法律制度等。

| Abstract: | Consistently improving the science and technology innovation mechanism has been pointed out in the report of the 18th National Congress of the Communist Party of China （CPC）. Science and technology innovation activities possess strong positive exter- nality, and it has been playing a great role in promoting the national economic and social development. In order to stimulate the positive externality of technological innovation, based on learning from foreign experience, adhere to the principle of appropriateness, proportion- ality, innovation and legality, improve the system of tax law system, financial legal system, government procurement, legal system, finan- cial and legal system, etc for stimulating positive externality of technological innovation. |
