| 摘 要： | 社会形势的演变对刑事政策的变迁具有某种决定意义,而宽严相济的刑事政策对于促进社会和谐发展、实现全面小康具有保障作用。宽严相济刑事政策的实现需要一系列具体制度的支持,因此需要在诸如恢复性司法、社区矫正、死刑复核程序等涉及刑事立法和司法方面进行多维度的制度设计和改革。

| Abstract: | Changes in social conditions play a decisive role in the changes of criminal policies,and the policies combining generosity and strictness will be contributable to promoting the harmonious development of the society and achieving all-round prosperity.However,such policies need a series of supportive systems;therefore,it is necessary to carry out multi-dimensional designing and reform in restorative justice,community-based correction,death penalty reviewing procedures and so on. |
