论遗失物拾得人的报酬请求权

关于遗失物拾得人是否应该享有报酬请求权,国外立法和学界皆存有争议。有别于一些国外的立法,我国法律没有赋予拾得人法定报酬请求权,《物权法》仅规定拾得人享有约定报酬请求权。这一规定不仅有其理论渊源,体现了马克思主义的权利义务观,是对我国优秀传统法律文化的继承和发扬,而且符合现阶段构建中国特色社会主义和谐社会的国情和法治理念。
