| 摘 要： | 近些年来,我国的劳动争议案件逐年递升且处理难度日趋加剧、社会影响力不断扩大,现行的劳动争议处理制度不尽完善难以适应现实需要,劳动争议案件得不到及时、有效的处理,不利于劳动者合法权益的保护,也给社会的和谐发展带来负面影响。本文在认识我国现行劳动争议处理体制主要特点的基础上,从对我国现行体制存在缺陷的分析入手,提出适合我国国情和现实情况的劳动争议处理新体制——双轨制模式,并提议进行一系列的改革,使新体制的作用得以发挥。
