| 摘 要： | 正当程序是实现程序正义的基本条件 ,是通向实体正义的必要途径。正当程序的实施必须要做到裁判者处中立地位、当事人各方 (包括刑诉中的控辩双方 )地位平等、当事人作为程序主体享有充分的诉讼权利、司法过程公开、司法程序文明这几个基本要求 ,同时还须从立法和司法两种途径保障其有效地实施
