| 摘 要： | 我国现行专利权行政保护的诸多局限性不利于企业自主创新。近年来,随着知识产权战略的深入实施,主要发达国家在加强专利权司法保护的同时,普遍强化了专利权的行政保护,取得了较好成效,积累了丰富的经验,应该借鉴发达国家经验,不断完善我国专利权行政执法制度,激励自主创新。 |

| Abstract: | There are many limitations of present administrative protection of patents in our country,which is not conducive to firms＇ independent innovation.In recent years,with the thorough implementation of IP strategy,major developed countries have generally strengthened the administrative protection of patents as well as the judicial protection of the same,and achieved good results and accumulated abundant experience.We should learn from the experience of developed countries to continuously improve our administrative law enforcement system on patent,and to encourage firms＇ independent innovation. |
