| 摘 要： | 不法原因给付是大陆法系中重要的民法制度,而英美法系中也有类似规定,通过对该制度各国(地区)立法例的考察与评析,结合我国处理类似问题的法律规定,认为其存在一定的弊端,并主张借鉴各国立法,改良该制度并引进我国。

| Abstract: | Unlawful cause prestation is an important legal system of civil law in continental law system,and similar laws exist in England and American law system.The investigation and analysis on instance of legislation of the system in varied countries and areas,with the consideration of lawful regulations dealing with similar cases in our country,expresses the abuses of the system in our country.The article advocates drawing on the experiences of legislation in other countries,improving the system and introducing it to our country. |
