社会保障权的界定和历史考察

社会保障权是社会成员在生存与发展面临社会风险时,在自由意志的前提下,通过行为自由而从国家和社会获得符合社会正义的利益,以满足其维持基本生存乃至提高生活质量之需要的资格。社会保障权的根本目的是保障人的生存和发展。其形成和发展存在着一条明显的历史轨迹:社会救助型发展阶段——社会保障权的萌芽和初步形成;社会保险型发展阶段——社会保障权的确立和进一步发展;社会福利型发展阶段——社会保障权的成熟和拓展。

Definition and Historical Investigation of the Right to Social Security

The right to social security is entitlement that can get interests in order to meet the need of keeping basic surviving and improving living quality, which accord with social justice on the premise of free will when social members face social danger. The fundamental goal of the right to social security is to ensure the survival and developement of human beings. There is an obvious historical orbit in the forming and developing of it: firstly, it begins to sprout and form initially at the developing stage of social assistance ; secondly, it is established and further developed at the developing stage of social insurance ; thirdly, it is riped and extended at the developing stage of social welfare.
