论我国重大误解制度的缺陷及立法完善

重大误解行为是行为人因对与行为相关的重要事实发生错误认识,而做出的与内心意思不一致的表示行为,该行为给行为人或相对人造成了较大损失。重大误解行为属于可变更可撤销的民事行为,当事人均享有撤销权,但是应对其撤销权和变更权予以限制。我国民法对于重大误解制度的规定,无论在定义上,还是在法律后果上,都存在一定的局限,应加以完善。

On the Defects and Legislation Perfection of China Significant Misunderstanding System

Significant misunderstanding behavior,made by civil subjects based on their misunderstanding of the important facts,is inconsistent with their inner intention,and causes a great loss to the actor or the counterpart.Significant misunderstanding behavior is the civil behavior that can be changed or cancelled.Both of the parties have the right of rescinding and changing.But the right of rescinding and changing shall be restricted by law.Our civil law for significant misunderstanding system is imperfect both in definition and in the legal consequences,and must be perfected.
