多元纠纷解决机制之正当性与可行性探析——以诉讼与非诉讼相衔接的纠纷解决机制为视角

当前我国社会矛盾处于多发期,单独依靠某一种纠纷解决机制很难有效地化解各种类型的矛盾。实现诉讼与非诉讼两类纠纷解决机制的合理衔接已成为社会发展的必然要求。无论是从衔接机制内部层次进行分析,还是从其周边配套予以考量,均可发现促成两类纠纷解决机制的有机衔接与整合实属正当;同时,实现两类解纷机制的有机衔接与整合所应具备的实施条件业已成熟。

On Legitimacy and Feasibility of the Multiple Dispute Resolution Mechanism——to the convergence of litigation and non-litigation dispute resolution mechanism

We can not resolve various types of conflicts by means of a single certain dispute settlement mechanism in period of high conflicts.Implement the reasonable convergence of two types of litigation and non-litigation dispute resolution mechanism has become the inevitable demand of social development.Whether it is the internal mechanism from the convergence of levels of analysis,or its surrounding facilities to be considered,can be found in two types of dispute resolution mechanisms to promote convergence and integration of organic it is legitimate;in the same time,two divergent mechanisms to achieve the organic solution convergence and integration of the implementation of the conditions should have been mature.
