商标侵权纠纷是否适用赔礼道歉

摘    要:赔礼道歉是否适用商标侵权案件,无论在理论上、立法上还是司法中,都存在争议。一般来说,商标一旦投入商业使用并随着商品行销市场,就能获得社会公众的客观评价,就在一定程度上积累了信誉。商标作为商业信誉的载体,从某种程度上说,对商标权的保护实际上是对附着在商标上的商业信誉的保护,所以对商誉的保护是必要的。但是赔礼道歉在中国传统理论和立法上有其特定的内涵,且作为商标侵权的民事责任方式,其道德基础和原有的功能会受到破坏。鉴于赔礼道歉的局限性和考虑到保护商标信誉的特定需要,可以考虑引进“信誉回复制度”。

Abstract:it is controversial whether apology applies to a dispute over trademark infringement in theory,legislative and judicature.Generally speaking,once a trade mark has been put into business and marketed with the commodity,it will gain objective evaluation from the public and accumulate its credit to some degree.Since a trademark is a carrier of the commercial reputation,in a sense,the protection of trademark right means that of commercial credit attached to it,and it is necessary.But apology has a specific connotation in Chinese traditional theory and legislative,and its moral base and original function will be destroyed if it is used as a form of bearing civil liability in trademark infringement.In consideration of the limitations of apology and the particular need to protect trademark credit,It is reasonable to introduce credit revivification system
