| 摘 要： | 在封建专制社会条件下,皇帝掌握国家的最高统治权力。明代专制主义极端发展,皇帝对司法权的控制超过历代。皇帝不仅通过他所掌握的最高司法权控制着全国的司法,而且把这种权力不断地扩大,使其为强化政治和经济的皇权服务,从而导致司法的专横和专制主义的极端发展。
