| 摘 要： | 鉴于目前我国未成年人犯罪的发展态势,目前我国刑法对未成年人犯罪采取的刑罚手段存在不足, 应当借鉴国外的前科消灭、不定期刑等刑罚种类,重建我国未成年犯罪人刑罚体系,更好地保护未成年人的各项权利,使其受到公正、人道的司法处理。 |

| Abstract: | According to our present law, there is no sufficient means to restrain from the tendency of more juvenile delinquency. We should adopt the experiences practiced in other countries for reference, to reconstruct our national system of punishment, for example, the abolition of crime record and indeterminate sentences. In this way, the rights of the juvenile population will be better preserved and juvenile delinquency will be treated fairly and morally. |
