死刑缓期执行若干问题的研究

死刑缓期执行,是贯彻我国“少杀、慎杀”死刑政策的一项有效制度,对于限制死刑、减少死刑发挥了积极作用。但刑法理论和司法实践对死刑缓期执行有关适用方面的问题存在着较大的争议和一些认识误区,因而,有必要对死刑缓执行的若干问题作进一步研究。据此,笔者着重论述了死刑缓期执行的六个问题。

A Study Over Several Issues Concerning Suspension of Execution of Death Penalty

Suspension of execution of death penalty is an effective method to perform the policy of death penalty which is "to kill little and kill carefully", which plays a positive role in limiting and decreasing death penalty. However, there are many controversies in the fields of criminal legal theory and many misunderstandings in the judicial world. Thus, it is necessary to strengthen a study on suspension of execution of death penalty. The author emphasizes a discussion on six issues concerning suspension of execution of death penalty.
