摘    要:建筑物区分所有权内涵的三元论说,即包含专有权、共有权和成员权,因共有权而产生的纠纷占了区分所有权纠纷的绝大部分。我国建筑物区分所有权人之共有权法律制度还有一些缺陷,应从多方面加以完善。

Abstract:Trialism theory of the condominium ownership of the residential building includes: exclusive right;membership right,disputes by joint ownership account the condominium ownership for most.There are some defects for our law system of condominium proprietor’s joint ownership of the residential building,ought to be consummated in many respects.
