试论宽严相济刑事政策的运用——以东莞检察机关办理加工贸易走私案件为视角

加工贸易转型升级是当前东莞市经济社会双转型的关键,检察机关在办理加工贸易走私案件中落实双转型战略,也必然以促进加工贸易企业转型升级为着力点,进一步解放思想,大力贯彻宽严相济刑事司法政策。既要重点保护一部分守法经营、符合产业政策涉案企业的生存发展,也要重点打击一部分走私情节恶劣的不法企业,净化市场环境,宽严相济,服务东莞市加工贸易转型升级。

The Adaptation of Combining Tolerance and Severity Policyin the Prosecution of Smuggling Crime in Processing Commerce Industry: Dongguan Public Prosecution of Such Cases as an Example

The transformation and upgrading of processing commerce industry is one of the essential aspects of the economic and social transformation of Dongguan City.The Public Prosecution Bureau could assist this reform by adopting tolerance and severity policy in dealing with the smuggling crime in the processing commerce industry.On the one hand,the administration should protect some law-abiding,higher-industrial-grade corporations.On the other hand,for the seriously law breaking,low-industrial-grade corporations,severe punishment should be issued.This measurement could help with the cleansing of market environment and assist with the transformation and upgrading of processing commerce industry.
