| 贪污罪侵害客体问题评析 | |

| 摘 要： | 贪污罪侵犯客体的诸观点包括10余种，但笔者认为，宜将贪污罪客体表述为国家工作人员职务行为的廉洁性和公共财物的所有权，并且此两者具有两层基本关系：一是层次递进关系，第一层次是公共财产所有权，第二层次是国家工作人员职务行为的廉洁性；二是因果关系．公共财物的所有权与国家工作人员职务行为的廉洁性两者存在原因与结果的关系。 |

| Abstract: | The viewpoints on encroachment on the object of corruption crime exceed 10 kinds ,but I think ,the object of corruption crime shoud properly express the integrity of state functionary official activities and ownership of public properties,and two kinds of object have two basic relationships:one is relationship of succession of different levels,the first level is ownership of public properties ,the second level is the integrity of state functionary official activities;the other is relationship of causation,or the relationship between the ownership of public properties and the integrity of state functionary official activities. |
