关于建立证人资格豁免制度的理性思考

为维护正常的社会秩序,避免因某些证人的证言使其他的社会价值和利益遭受损害,西方国家对基于特定身份的人如配偶、律师、医生在作证方面基本都规定了证人特权,我国法律中尚无拒证权的规定。为使法律体现出的价值与人的本性相一致,以便更好地维护社会道德和伦理秩序,从而更好地实现法律的价值和目的,有必要排除这些人作为证人的资格,建立证人资格豁免制度。

The Consideration of Establishing the System of Competency Exemption

For maintaining normal social order and avoiding the hurt to some social values and interests caused by the testimony of certain witnesses.Western countries provide people with specific identities,such as spouses,lawyers and doctors with immunity to testimony.Many domestic scholars also advocate the provision of the right to refusal of testimony in Chinese Procedural Laws.In the opinion of the author,in order to harmonize the legal value and human nature nod to preserve the moral and ethic order so as to better realize legal ends,it is necessary to put out the capacity of the above mentioned people as witness and to establish the competency exemption system
