论《劳动合同法》在高校教师聘任改革中的实施

摘    要:高校劳动关系是社会劳动关系的一个组成部分,其本质是知识资本下的协作劳动——智本协作劳动。《劳动合同法》的实施将对高校教师聘任改革产生极大的推动作用。高校聘任改革应以《劳动合同法》的颁布实施为契机,在充分认识高校劳动本质的基础上,以人为本,实现教师劳动者的权利义务平衡。

Abstract:The university employment relationship,the essence of which is cooperation work of the intelligence capital,is a part of social employment relationship.Based on human-centeredness and full understanding of the essence of university employment,the implementation of Law on Employment Contracts offers a good opportunity to realize the balance between teachers' rights and obligations.
