| 摘 要： | 直接言词原则对实体真实的实现,存在积极和消极两方面的影响,因此,应对其进行利弊权衡。一方面,要充分肯定直接言词原则的诉讼价值,尽快确立直接言词原则;另方面,也要看到间接书面审理的有益之处,制定直接言词原则的例外规则。

| Abstract: | The principle of direct speech have aggressive and negative influences to realize the true of entity. Therefore, we should cany on gains "or losses' weigh to it. On one hand , the procedure value of the principle of direct speech should be well affirmed , and to establish the principle as soon as possible ; on the other hand, we should also see the benefit of indirect writing judgement to draw up the exceptional rule of the principle of direct speech . |
