通过对中西诉讼文化差异的比较,指出中西传统诉讼文化主要存在三点不同:一、思想意识基础不同,中国传统诉讼文化以儒家文化为思想基础,西方传统诉讼文化以基督教宗教文化为思想基础.二、诉讼文化价值取向不同,中国传统诉讼文化追求“无讼”,西方传统诉讼文化追求以实现正义为价值目标.三、在形式上表现出对程序的重视程度不同,中国传统诉讼文化重实体轻程序,西方传统诉讼重视程序价值.文化基础的不同应当在我们移植西方诉讼制度,建设社会主义现代法治的过程中予以考虑并引起相当的重视.

Comparition of China-Western traditional Lawsuit Culture

By compared Chinese and western traditional lawsuit culture, author pointed out three differents between them. First is the basic of ideology ; Second is the concept of the value; The last one is procedure .The aim of these comparisons is to point out the cultural foundation differents between two traditional lawsuit system. These differents must be thought about when we transplant the western lawsuit system. And these differents must be pay attention on while we build our socialism modern lawsuit system.
