商品房预购人权益的物权法保护

摘    要:商品房预售是房地产开发的一种主要筹资方式,但由于商品房预售交易的特殊性,预购人往往处于一种“弱势”境地,权益受侵害现象难以遏制,因而对处于弱势的预购人权益给予法律的倾斜性保护已迫在眉睫,物权法的概括性规定对预购人权益保护起到了一定的作用,但其制度还需作针对性的完善,以切实保护预购人在商品房预售中的权益。
