| 摘 要： | 对新《婚姻法》的热点问题进行经济分析，可以看出情感的不稳定性，这符合西方经济学中的边际效用递减规律，婚姻得以继续维持下去可以用劳动价值论来解释，双方的互相需要也就是供求的平衡。感情破裂导致离婚往往使女子处于不利地位，政府通过《婚姻法》保障女子的利益，这也与政府采购的收入分配职能原理相同。

| Abstract: | An analysis of the focus problem of the new marriage law shows the unstable of emotion. It confirms to the law of decrement marginal utility in the western economic: the persistence of marriage can be interpreted by the theory of labor value,the needs of each other is just as the balance of production and requirement the divorce caused by love-broken usually put woman in unprofitable place the legislature protects .Womans right and profit Just as the government makes measurement to balance the incomes around different classes. |
