论司法能动过程中价值判断的相对确定性

司法能动主义的基本宗旨是强调对法官施加较少的约束从而使法官能够广泛地运用自身的权力去促进公平。司法能动主义的宗旨给法官提供了能够进行广泛价值判断的空间,但是这并不意味着司法能动过程中法官的价值判断是恣意的。本文通过分析法官在进行价值判断时的若干制约因素得出了司法能动过程中法官的价值判断是具有确定性的这一结论。

On Relative Certainty of the Value Judgment in the Process of Judicial Activism

The basic tenet of judicial activism emphasizes that judges should be imposed less constraint, so that they can widely use their power to promote justice. The aim of judicial activism is to give judges extensive space for value judgment, but this doesn＇ t mean that the value judgment of judges is arbitrary in the process of judicial activism. Based on the analysis of some restricting factors im posed to judges, this paper concludes that the value judgment of judges has certainty in the process of judicial activism.
