我国政府规制改革范畴与绩效建设的思路

“放松规制”是新公共管理改革运动的一项重要内容。但体制转轨国家不能全盘照搬西方发达国家成功的改革范式。通过对政府管辖事务的内容、运行模式及中国特定社会状况分析的基础上,推导出中国政府规制改革范式是:全面放松政府管辖事务基本职能的规制,进一步加强并规范政府管辖事务运行职能的规制,保证被规制者的合法权益受损害时能得到有效救济,同时还要培育守法的社会人。

Regulatory Reform Areas in China and Thought of Construction of the Performance

"To relax regulation" is an important part of new public management reform movement.But the countries in structural transformation cannot completely follow the successful reform paradigm of western developed counteies.Based on the analysis of government's jurisdiction,the mode of operation and China's specific social conditions,the article derives the paradigm of China's regulatory reform: relax the regulation of the basic functions of government jurisdiction affairs,further strengthen the regulations of operating functions of the government jurisdiction to guarantee that the regulaters' legitimate rights and interests can be effectively relieved while in damage,and meanwhile,cultivate law-abiding people in society.
